VaultTail Product-Specific Terms

These Product Terms form an agreement between you and the person or entity identified as the publisher of VaultTail in the Microsoft Store listing or other distribution information supplied with the application (the Publisher). By selecting I agree or using VaultTail, you accept these Product Terms. If you do not agree, select I do not agree and do not use the application.

If you acquired VaultTail through Microsoft Store, these Product Terms supplement and incorporate the Microsoft Standard Application License Terms (SALT) applicable in the country or region where you acquired the application. These Product Terms add information specific to VaultTail and do not reduce any protection granted by the SALT or applicable law. Mandatory law controls whenever it cannot lawfully be changed by agreement.

1. What VaultTail does

VaultTail is a local Windows desktop application that copies files from folders you select to a removable or external drive that you select and link. Version 1.0 can compare files, copy new or changed files, optionally verify copied contents, start a backup after the linked drive is connected, and attempt to continue an interrupted operation after reconnection.

VaultTail maintains a current backup copy in a VaultTail-managed location on one linked drive. It is not a historical-version archive, a mirror that deletes destination files when source files are deleted, a cloud-storage or synchronization service, an encryption or antivirus product, anti-ransomware protection, a forensic or data-recovery service, or a guarantee against data loss.

An existing destination copy may be replaced when the corresponding source file is copied again. Files deleted from a source folder may remain in the backup. VaultTail does not promise to preserve every permission, ownership entry, EFS state, alternate data stream, reparse point, link, or file-system attribute. Unsupported links and inaccessible files may be skipped or reported for attention. VaultTail has no separate restore wizard; ordinary backup files can be accessed through Windows.

2. Source files and the linked drive

You retain all rights in your source files and backup files. VaultTail acquires no ownership of them. For backup operations, VaultTail reads files only from folders you select. Backup operations are not designed to delete, rename, format, encrypt, or intentionally modify source files.

On a drive you select or link, VaultTail may create and update a managed backup folder, replace destination copies, and create service data required for drive identification, comparison, verification, and interrupted-operation recovery. Service data may include hidden marker files, indexes, manifests, checkpoints, diagnostic information, and temporary .part files. VaultTail may enumerate eligible external drives and read VaultTail marker data to identify the linked drive. VaultTail does not format a drive.

Unlinking a drive or uninstalling VaultTail does not necessarily remove backup files or VaultTail service data from that drive. You remain responsible for retaining, moving, or securely erasing those files.

3. Your responsibilities and backup risk

You are responsible for selecting the intended folders and external drive; having the legal right to read and copy the selected files; maintaining sufficient free space and functioning hardware, cables, ports, file systems, and Windows; keeping at least one independent backup of important data; checking the result and confirming that important files can be opened; and protecting, safely removing, erasing, and disposing of storage devices.

VaultTail is a backup aid and should not be the only copy of important or irreplaceable data. Hardware failure, unsafe removal, file-system corruption, insufficient space, permission restrictions, locked or changing files, malware, power loss, drivers, Windows faults, and other events outside the Publisher’s control may interrupt an operation or make files unavailable. VaultTail attempts its supported pause, reconnection, checkpoint, and verification behavior, but does not promise that every operation can be resumed or recovered.

If the Store listing identifies a release as beta, preview, or pre-release, it may contain additional defects and should not be used as the sole protection for critical data. This statement does not reduce mandatory consumer rights.

4. Local operation, privacy, and logs

Core backup operations are performed locally and do not require an Internet connection. Microsoft Store acquisition, licensing, and updates may use Internet access under Microsoft’s terms.

VaultTail version 1.0 does not intentionally upload or transmit source-file contents, backup-file contents, selected-folder contents, or VaultTail diagnostic logs to the Publisher or third parties. It contains no advertising, analytics, telemetry, cloud synchronization, or account system.

VaultTail stores settings, linked-drive identity data, indexes, recovery checkpoints, and diagnostic logs locally. Logs may contain full file or folder paths, drive information, timestamps, operation results, and error codes. The VaultTail Privacy Policy, available in the application and through its Store information, explains this processing and the user’s controls.

5. Optional startup, notifications, and Windows drive repair

Start with Windows is optional, is on by default, and can be disabled in VaultTail or Windows. It is separate from automatic backup after connection of the linked drive. Notifications are optional, and core backup controls remain available when Windows notifications are disabled.

After certain drive errors, VaultTail may offer a user-initiated action that asks Windows to check and repair the file system. Windows may request administrator approval, and its repair operation may modify file-system metadata. VaultTail does not start that repair without your action and the Windows permission prompt. Neither VaultTail nor the Publisher guarantees the result of a Windows repair operation.

6. Updates, support, and mandatory remedies

Updates may be supplied through Microsoft Store. The Publisher will provide updates required by applicable law and any additional updates expressly promised in the Store listing. No promise of lifetime support, indefinite compatibility, or a particular support period is made unless stated in the Store listing.

Support, when offered, is provided through the support contact shown in the Store listing or distribution information. Microsoft, device manufacturers, and storage-device vendors are not responsible for supporting VaultTail unless identified as the Publisher.

If VaultTail is not supplied or does not conform to the contract, applicable law may provide rights to correction, a proportionate price reduction, termination, refund, damages, or other remedies. Those rights are not reduced by these Product Terms.

7. Warranty and liability

Except for warranties, guarantees, conformity obligations, and remedies that cannot be excluded or restricted under applicable law, warranty and liability are governed by the SALT and applicable law. These Product Terms do not create an additional warranty or separate limitation of liability.

To the maximum extent permitted by applicable law, the Publisher does not promise uninterrupted or error-free operation, compatibility with every computer or drive, completion of every backup, preservation of every file or metadata item, or recovery after every hardware, software, file-system, or user failure.

Nothing in these Product Terms excludes or limits liability where doing so is prohibited by law, including, where applicable, liability for fraud, wilful misconduct, gross negligence, death or personal injury caused by negligence, or breach of mandatory consumer law.

8. License and acceptable use

VaultTail is licensed, not sold. Subject to these Product Terms, the SALT, Microsoft Store Usage Rules, and applicable law, you receive a personal or internal-business, non-exclusive, non-transferable license to install and use VaultTail on permitted Windows devices.

You may not circumvent technical limitations; distribute, rent, lease, sublicense, or sell the application; or reverse engineer, decompile, or disassemble it, except to the extent applicable law expressly permits. You may not use VaultTail unlawfully or to copy data you have no right to copy.

VaultTail includes third-party components licensed by their respective owners. Their notices are available in the application package. Microsoft trademarks and products belong to Microsoft; VaultTail is an independent product and is not endorsed by Microsoft.

9. Termination and uninstall

Your license ends if you materially breach these Product Terms and fail to cure the breach where applicable law requires an opportunity to do so. On termination, you must stop using and uninstall VaultTail. Termination or uninstall does not transfer or erase your ownership of source or backup files and may leave local settings, logs, backup files, and service data until removed by you, the application, or the operating system.

10. Changes, law, and severability

The Publisher may revise these Product Terms for a future version or when reasonably necessary for security, legal compliance, or changed functionality. A revision will not retroactively reduce accrued rights. Material changes will be presented before they take effect and, where required, will require fresh acceptance.

Governing law, available courts, and dispute rights are determined by the SALT and mandatory applicable law. Nothing requires a consumer to give up a court, remedy, or protection that mandatory law makes available.

If a provision is invalid, unfair, or not binding under applicable law, it will not bind the user, and the remainder will continue only if it can do so without that provision. These Product Terms, the SALT, the applicable Privacy Policy, the Store listing, and additional terms accompanying an update form the agreement for VaultTail to the extent recognized by applicable law.

These Product Terms are provided in the languages supported by VaultTail. No translation limits mandatory rights. Where applicable law requires, ambiguity is interpreted in the manner most favorable to the consumer.

11. Mandatory consumer rights

If you are a consumer, nothing in these Product Terms excludes, restricts, suspends, or waives any right or remedy that cannot lawfully be excluded or restricted, including rights relating to supply, conformity, security updates, correction, price reduction, termination, refund, damages, or unfair contract terms. Any disclaimer, limitation, or allocation of risk applies only to the maximum extent permitted by applicable law.
